Terms and conditions of the E-ROTICA events

1. General Provisions
These are the basic rules for attending the Event, including who can participate, the need for valid tickets, and the Organizer's right to deny admission if conditions aren’t met.

These Terms and Conditions ("Regulations") govern the participation in events ("Event(s)") organized by SO FAR SO GOOD Grzegorz Ciwoniuk, NIP: 9661925857, hereinafter referred to as the "Organizer." By attending or participating in the Event, each individual agrees to be bound by these Regulations.

The Regulations form an integral part of the agreement between the Organizer and the individual attending the Event, hereinafter referred to as the "Participant."

A valid ticket purchase constitutes acceptance of these Regulations and serves as confirmation of the Participant's agreement to comply with all conditions set forth herein. Upon purchase, the ticket holder is considered a Participant as defined in these Regulations.

Admission to the Event organized by the Organizer is granted under the following conditions:
- Age Restriction: Only individuals aged 18 or above are permitted to attend the Event. The Organizer reserves the right to request a valid government-issued photo identification to verify age.
- Ticket Validity: A Participant must present a valid ticket at the point of entry. Tickets are non-transferable and must match the identity of the individual seeking entry if stipulated by the Organizer.
- Authorized Personnel: Representatives of state or medical services may be granted entry solely for the purposes of their professional duties. Such entry requires prior agreement with the Organizer and the presentation of valid identification.

The Organizer retains the right to deny admission to any individual who fails to meet these requirements or violates any provision of these Regulations, without providing a refund or other compensation.
2. Responsibilities of the Organizer
The Organizer ensures the Event is organized and provides valid tickets, but they are not responsible for issues beyond their control. Refunds are possible under specific conditions.
- The Organizer is responsible for:
- Providing the Participant with access to a valid ticket purchased through an authorized sales channel for participation in the Event.
- Making reasonable efforts to organize and facilitate the Event, including ensuring its smooth conduct, to the extent possible and within the Organizer's control.

Only tickets purchased from authorized points of sale grant the right to participate in the Event. The Organizer accepts no responsibility for tickets obtained through unauthorized sources.

The Organizer reserves the right to cancel the Event without prior notice due to circumstances beyond their reasonable control, including but not limited to force majeure events, legal restrictions, or other extraordinary situations. In such cases, the Participant’s rights will be governed exclusively by applicable laws, including but not limited to the Civil Code. The Organizer shall not be liable for any indirect or consequential damages arising from the cancellation.

The Organizer retains the right to modify the date, venue, or program of the Event for reasons beyond their control, including but not limited to:
- Force majeure events, such as natural disasters or emergencies.
- Official declarations of national mourning or other state-mandated restrictions.
- Adverse weather conditions that may jeopardize the safety of the Event.
- Illness, injury, or other incapacity of performers or essential staff.
- The need to ensure the safety, health, or wellbeing of attendees, staff, or property, or to prevent disruptions to the Event.

In the event of a change to the date, venue (excluding changes within the same locality), or performers, the Participant may request a refund of the ticket price under the following conditions:
- For cancellations: Refunds must be requested promptly upon notification of the cancellation.
- For other changes: Refunds must be requested before the commencement of the Event.
- Refunds will only be granted if requested within 30 days of the original Event date.
- A valid fiscal receipt issued at the time of ticket purchase must be presented to process the refund.

The Organizer provides a cloakroom for the convenience of Participants, subject to limited capacity. Availability of the cloakroom is not guaranteed, and the lack of space shall not constitute grounds for a claim, refund, or other form of compensation.

The Organizer assumes no responsibility for items left in the cloakroom or elsewhere on the Event premises. Participants are solely responsible for safeguarding their personal belongings. By using the cloakroom, Participants acknowledge and accept these limitations.

In the event of a lost cloakroom number, a replacement fee of PLN 50 will be charged to the Participant. The Organizer is not obligated to reimburse or replace items stored in the cloakroom under any circumstances.

The Organizer reserves the right to make operational decisions at their sole discretion, including imposing additional safety measures, denying entry, or removing individuals from the premises in cases of non-compliance with these Regulations or disruptive behavior. No refund or compensation will be provided in such cases.
3. Event Safety
Safety comes first! Prohibited items and actions are outlined, and security measures are strictly enforced. Participants must follow all rules and instructions to ensure everyone’s safety.

For the safety and security of all Participants, the Organizer reserves the right to:
- Deny entry to any Participant if security considerations justify such action.

Require any Participant to leave the Event area if security concerns arise. This includes but is not limited to situations where a Participant disrupts public order, behaves aggressively, violates these Regulations, or poses a threat to the safety or smooth operation of the Event. The Organizer may take any necessary actions to enforce compliance.

Refuse entry to individuals found in possession of prohibited items, including but not limited to weapons, shoes with metal ends, or other objects deemed hazardous to others or the uninterrupted course of the Event.
- Prohibited Items: It is strictly prohibited to bring, possess, or use the following items on the Event premises:
- Weapons or dangerous objects.
- Explosives or pyrotechnics.
- Laser pointers.
- Pepper spray.
- Fire hazardous materials.
- Narcotics or psychotropic substances.
- Alcoholic beverages, except those purchased on-site at the Event.
- Food items, except those purchased on-site at the Event.
- Tripods, monopods, or telescopic booms (e.g., selfie sticks).
- Musical instruments or devices that could disrupt the Event.
- Sharp, heavy, or glass objects, including umbrellas, binoculars (other than theatrical ones), or clothing/accessories containing hard or heavy elements that could cause harm upon contact.
- Folding or tourist seats.
- Animals, except certified service animals.
- Any other items deemed by the Organizer to pose a safety risk.
- Prohibited Actions:

Sexual harassment, discrimination, or any form of abusive behavior toward Participants, staff, or performers is strictly prohibited. This includes, but is not limited to, acts of sexual misconduct, hate speech, or displays of homophobia, transphobia, or other discriminatory behavior. Violators will be immediately removed from the Event premises, and evidence of misconduct may be forwarded to relevant authorities.
- Smoking tobacco products is permitted only in designated areas within the Event premises. Smoking outside these areas is strictly prohibited.
- Activities that could cause fire or pose a hazard to others are prohibited.
- The Organizer reserves the right to:
- Deny entry or remove from the Event premises any individual found in possession of prohibited items or engaging in prohibited actions.
- Refuse to provide storage for prohibited items; Participants must ensure compliance before arrival.
- Liability Disclaimer:
- Participants enter the Event premises at their own risk and responsibility. The Organizer is not liable for damages to personal items or loss of health or life caused by third parties.
- The Organizer’s liability is limited to cases of gross negligence or intentional misconduct.
- Participant Responsibility:
- Individuals on the Event premises are responsible for their actions and must comply with applicable laws.
- Material liability for damages rests solely with the individual who caused the damage.
- Participant Obligations:

Participants must comply immediately with instructions from law enforcement or security personnel, who are tasked with ensuring the Event’s safety. Non-compliance may result in immediate removal from the premises without refund.
- All Participants must carry and present a valid ticket or wristband upon request by the Organizer.
- Emergency Procedures:
- In case of fire:
- Notify the fire department at 998.
- Use available fire extinguishing equipment.
- Inform security personnel or law enforcement.
- In case of a medical emergency:
- Notify ambulance services at 999.
- Provide first aid if capable.
- Inform security personnel or law enforcement.
- Monitoring and Evidence:
- To ensure participant safety, the Event premises may be monitored by video surveillance. Footage will be archived for up to 30 days.
- Evidence of blatant violations of these Regulations or actions endangering participant safety will be handed over to authorized authorities.
4. Hazard Warning
The Event may feature loud sounds, strobe lights, and other effects that could pose risks to some people. By attending, you accept these risks and are encouraged to use protective gear if needed.

The Organizer informs Participants and all other individuals present on the Event premises that they may be exposed to continuous zones of significant sound intensity, which may cause hearing damage. Additionally, strobe lighting, laser effects, and other visual effects used during the Event may cause visual discomfort or other ailments.

Individuals particularly vulnerable to these risks, including pregnant women, elderly persons, and individuals with epilepsy, are strongly advised to consult a qualified medical professional prior to attending the Event to assess their ability to safely participate.

The Organizer further warns that sound waves during performances may pose heightened risks to children under the age of one. Participants or guardians of such individuals must seek appropriate medical advice before deciding to bring children to the Event premises.

Due to the potential presence of intense and temporary sound waves, the Organizer recommends that all Participants use specialized hearing protection during the Event to mitigate the risk of hearing damage.

The Organizer disclaims all responsibility for any hearing damage, visual ailments, or other physical or psychological effects experienced by Participants or other persons on the Event premises as a result of sound activities, strobe lights, laser effects, or any other effects, even if these were announced or are part of the scheduled Event program.

By entering the Event premises, the Participant gives informed consent to their participation, acknowledging and accepting the potential risks associated with sound, light, and laser effects. Participants assume full personal responsibility for any consequences arising from exposure to such effects.
5. Additional Provisions
The Organizer has the right to make changes to the Event or rules and to use photos or videos taken at the Event for promotional purposes. Participants must follow all instructions and accept these conditions.

The Rules and Regulations are made available on the Event website, at authorized ticket outlets, and on-site immediately before and during the Event. The Organizer reserves the right to update or amend these Rules and Regulations at any time. All changes will be published on the Event website and will take effect upon publication.

In the event of disputes or matters not covered by these Rules and Regulations, the applicable provisions of the Civil Code and/or the Criminal Code shall apply. The Organizer reserves the right to interpret these Rules and Regulations and resolve disputes related to Event participation at its sole discretion.

The purchased ticket constitutes an individual, revocable permission granted by the Organizer to attend the Event. This permission may be revoked at any time, without refund or compensation, for reasons related to security, public order, or non-compliance with these Rules and Regulations.

The Organizer reserves the right to record the Event using audio and visual recording devices, including the behavior and image of persons on the Event premises. By entering the Event premises, each Participant grants the Organizer consent to record and use their image for lawful purposes.

Each Participant agrees that their image may be used by the Organizer for promotional purposes, including but not limited to publication on the Organizer's website, social media platforms, and other marketing materials. Participants waive the right to review or approve such materials and acknowledge that no claims or compensation shall arise from the use of their image.

The Organizer will ensure that the recording and dissemination of images comply with applicable data protection laws. The image of persons present at the Event may be used for documentation, reporting, advertising, and promotional purposes.

The Organizer reserves the right to restrict or prohibit photography, videography, or other forms of recording on the Event premises to protect the privacy, safety, and rights of Participants, artists, and performers. Participants must comply with such restrictions when imposed.

All Participants are required to follow the Event rules and adhere to instructions provided by law enforcement, security personnel, and maintenance staff to ensure the safety, comfort, and enjoyment of all attendees. The Organizer reserves the right to remove from the Event premises any person who fails to comply with these rules or instructions, without refund or compensation.
